Acceptance of Terms
By accessing or using the Kelley TechServ mobile application and website (the "Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service.
Description of Service
Kelley TechServ is a proximity-based contractor trust network that connects verified home service contractors with nearby homeowners. The Service provides:
- Real-time GPS-based alerts when contractors are working in your neighborhood
- A platform for booking home services at competitive rates
- Verified contractor profiles with licensing and insurance information
- A rating and review system for quality assurance
- Complaint mediation services through Kelley TechServ
User Accounts
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Accept responsibility for all activities that occur under your account
Contractor Requirements
Contractors using the Service must:
- Hold valid and current licensing for their trade in the State of New Jersey
- Maintain adequate insurance coverage as required by law
- Submit to Kelley TechServ's vetting and verification process
- Provide honest and accurate information about their services and pricing
- Respond to customer complaints in a timely and professional manner
Homeowner Responsibilities
Homeowners using the Service agree to:
- Provide accurate location and contact information
- Submit honest and fair reviews of contractors
- Communicate respectfully with contractors
- Honor booking commitments unless cancelled with reasonable notice
Pricing & Payments
- Homeowner accounts are FREE. Homeowners pay nothing to use Kelley TechServ.
- Contractor subscriptions start at $99/month for a 90-day introductory trial period, then $149/month thereafter. The app itself is free to download.
- Service pricing between contractors and homeowners is set by the contractor. Kelley TechServ does not set or control service prices, but our contractors typically offer 15-20% lower rates than traditional platforms.
Dispute Resolution & Mediation
Kelley TechServ acts as a mediator between homeowners and contractors. If you experience any issues with a service:
- All complaints come directly to Kelley TechServ
- We will address the issue and act as a mediator between parties
- We work to find a fair resolution for both homeowners and contractors
- Contractors who consistently receive complaints may be removed from the platform
Marketing Communications
By creating an account, you may receive marketing communications including:
- Push notifications about nearby contractor availability
- Text messages with coupons and promotional offers
- Mail-delivered seasonal promotions and neighborhood deals
You may opt out of marketing communications at any time through your app settings, by replying STOP to text messages, by visiting our opt-out page, or by contacting us at privacy@kelleytechserv.com.
Intellectual Property
The Service and its original content, features, and functionality are owned by Kelley TechServ LLC and are protected by applicable copyright, trademark, and other intellectual property laws.
Limitation of Liability
Kelley TechServ LLC facilitates connections between homeowners and contractors but is not directly responsible for the quality of work performed. While we vet all contractors and mediate disputes, we are not a party to service agreements between homeowners and contractors.
Termination
We reserve the right to terminate or suspend your account at any time for violations of these Terms. You may also close your account at any time by contacting us.
Changes to Terms
We may modify these Terms at any time. We will provide notice of significant changes through the Service or via email. Continued use of the Service after changes constitutes acceptance of the new Terms.
Governing Law
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law provisions.
